Terms and conditions of use

3.2 Purpose

These terms govern access to and use of the lamarmarmi.com website (the “Site”), which serves to provide information and present the business of Lamar Marmi srl. The Site is not an online sales platform: no content constitutes an offer to the public under art. 1336 c.c. Quotes and contracts are formalised separately in writing.

3.3 Intellectual property

All content on the Site (texts, photographs of completed works, drawings, trademarks, logos, including the registered trademark “lamar•marmi natural stone”, structure and code) is the property of Lamar Marmi srl or of the respective owners and is protected by L. 633/1941 and by the Industrial Property Code. Reproduction, even in part, is prohibited without written authorisation, except for printing or downloading for personal, non-commercial use with acknowledgement of the source. Photographs of projects carried out for third parties are published with the clients’ consent, where necessary; any requests for removal can be sent to info@lamarmarmi.it.

3.4 Permitted use

Users undertake not to use the Site for unlawful purposes, not to introduce malicious code, not to attempt unauthorised access, and not to send through the forms any offensive or unlawful content, or data of third parties without authorisation. The Controller may suspend access in the event of violations.

3.5 Content and limitation of liability

Information is provided for guidance only and may be updated without notice. The characteristics of natural materials (colour, veining, porosity) vary by nature: photographs are illustrative and not binding. To the extent permitted by law, Lamar Marmi srl is not liable for damage arising from use of the Site, from interruptions of service, or from the content of third-party sites reachable through links, over which it has no control.

3.6 Contact forms

Requests sent through the Site do not create contractual obligations for the parties. Data are processed in accordance with the Privacy policy. Attachments sent must be free of third-party rights; users warrant that they are entitled to use them.

3.7 Languages

The Site is available in Italian, English, French, German and Spanish. The non-Italian versions are courtesy translations: in the event of any conflict, the Italian text prevails.

3.8 Governing law and jurisdiction

These terms are governed by Italian law. The Court of Lanciano has exclusive jurisdiction over any dispute relating to use of the Site, without prejudice to the mandatory jurisdiction of the consumer’s court under D.Lgs. 206/2005, where applicable. Consumers resident in the EU can use the European Commission’s ODR platform (ec.europa.eu/consumers/odr).

3.9 Changes

Lamar Marmi srl may change these terms at any time; changes take effect from their publication on the Site.
